Dealing with Enforcement from Local Authority - Enforcement for raised deck / platform in residential area

When a distraught new perspective client called us to explain how they had received a Council Enforcement notice we were quickly on hand to explain the process, the possible pitfalls, and what we could do next.

Our client had purchased a new build house with a severely sloping garden. They had proceeded to level this out raising the land up around 1m and altering fence panels accordingly.

Unfortunately, they had overlooked the possible need for planning permission. In the UK, decking or other raised platforms in your garden is permitted development, not needing an application for planning permission, providing:

The decking is no more than 30cm above the ground

Together with other extensions, outbuildings etc, the decking or platforms cover no more than 50 percent of the garden area.

None of the decking or platform is on land forward of a wall forming the principle elevation.

However, if in doubt it is always best to consult with B3architectural or another suitably qualified professional.

B3architectural went on to prepare plans, elevations, 3D visuals and a site section showing the new changes in the true context.

The result was successful retrospective permission within only 6 weeks and another happy client.
